Helpful Overview

These definitions were created to clarify commonly used expressions by The Literacy Keys, LLC. As the owner (a.k.a tutor, OG Expert, shipping department, et al.), I thought it important to explain a few basics.  You’ll want to read about our specific terms on our terms and conditions page.

Orton–Gillingham is a 100 year-old, time-tested approach that is specifically designed to help struggling students.  The approach  breaks material into smaller skills and practices the material until mastery is achieved. Multisensory techniques (sight, hearing, touch) engage multiple pathways in the brain to help students connect the information. OG is an approach. Each lesson is customized to a student’s learning needs. 

If your child is accepted as a tutoring client, reports will be shared periodically to demonstrate and monitor your child’s progress. For each session, you will be required to log on promptly, as time will not be added on at the end of the session if you or your child is late.  Students are expected to be sitting comfortably at a desk/table during the session, in a room free from distractions. Phone calls lasting more than fifteen minutes will be charged a fee. In order to avoid the additional payment, you can ask to join at the end of your child’s session for a quick chat during your child’s instructional time provided the total time does not exceed the time allotted for the session. 

In order for your child to have an effective session, the following is needed:

● Strong internet access with the Zoom app

● Electronic device with the ability to annotate.  A multisensory experience requires active participation. 

● Inexpensive stylus pen for penmanship and writing on the touchscreen

● Composition or spiral notebook

● Sharpened pencils with erasers

Session cancelations require at least 24-hour notice.  Failure to provide 24-hour notice will result in being charged for a full session. Invoices are emailed monthly and payment is required within 3 business days. Tutoring may be discontinued if the payment is repeatedly late.

Privacy is Important to Us

Our privacy policy is detailed on this page. The following is an overview while more privacy details are found further below on this page. 

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site, place an order, fill out a form, respond to a survey, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, phone number. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information. We expect all users to be adults, or over the age of 18. Said user(s) can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities. We believe it is important to protect the privacy of the very young. For that reason, our website is structured to attract adults who can afford to purchase our products. If you are a parent of a child younger than 13 we strongly encourage you to monitor your child’s activity and figure out how they got ahold of your credit card.

We may collect non-personal information about Users whenever they interact with our Site. The non-personal information may include the browser name, the type of computer and technical information about Users means of connection, such as the operating system and the Internet service providers utilized as well as other similar information. Our Site may use “cookies” to enhance User experience. We have a whole section on the use of cookies if you just keep scrolling down. Web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about Users. You may choose to set the web browser to refuse cookies or to alert you when cookies are being sent, with the understanding that some parts of the Site may not function properly.

We don’t want to annoy you, so we adopt appropriate data collection, storage, and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.  However, we are a small business and do not have the resources of NCIS.

We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates, and advertisers for the purposes outlined above. We may use third-party service providers to help us operate our business, the Site, and/or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission. REMEMBER THERE HAS TO BE AN UNSUBSCRIBE BUTTON ON EVERY EMAIL. Just click on it and the dreaded activity will cease.

If Users decide to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. We may use third-party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission.

We hope that you are not surprised that The Literacy Keys, LLC has the discretion to update this privacy policy at any time. Be assured that when we do, we will include the date on the Site. We encourage Users who have lots of free time to frequently check this page for any changes. You acknowledge and agree that it is your responsibility to review this privacy policy periodically when you can’t sleep in the middle of the night and become aware of all changes. Let’s face it. By using this Site, you agree to this policy. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.

Privacy Policy Details

This policy applies to TheLiteracyKeys.com, our online courses and digital products, our tutoring and consulting services, and our email communications and other digital platforms.

The Literacy Keys is operated by The Literacy Keys, LLC, at 297 Red Mills Road, Freehold, NY  12431 and can be emailed at info@theliteracykeys.com.  We operate in the United States. If you’re outside the US, you’re consenting to your information being transferred to and processed here, where privacy laws may differ from your own. The terms mentioned are defined accordingly: “You” means a parent, guardian or adult customer. “Student” means the child or adult learner receiving instruction. We may update this policy. Material changes will be posted here with a corresponding date.

What We Collect

a) Information you give us

When you buy something: your name, email, billing address, phone number, and the payment method you choose. Card numbers go directly to our payment processor. We never see or store them.

When you enroll a student: the student’s first name and last initial, age or grade, school or district, academic history, prior interventions, and your goals for them.

When you send us documents: psychoeducational evaluations, school records, IEPs, 504 plans, report cards, screening results and correspondence with a school. You send these; we don’t go looking for them.  

When you contact us: whatever you choose to write in an email, a contact form, a consultation booking or a course discussion.

When you subscribe: your email address and name.

 

b) Information collected automatically

When you visit the site we collect standard technical information: IP address, browser type, device type, pages viewed, time on page, and the site that referred you. This comes from cookies and similar technology. 

 

c) What we do not collect

We do not collect Social Security numbers, government ID numbers, financial account numbers, biometric data, precise geolocation, or information about a student’s race, religion, immigration status or sexual orientation. Please don’t send them. If you send a document containing information we don’t need, we’ll redact or delete it.

Why We Collect It

  • To deliver the instruction, course or consultation you bought
  • To plan lessons and track progress
  • To schedule sessions and communicate with you
  • To process payment and issue receipts
  • To generate the invoices and attendance records your funding program requires
  • To answer your questions
  • To send an email you asked for
  • To improve our materials and understand which of our free content is useful
  • To keep records we’re required to keep, and to protect our legal rights

 

We do not use student information to build advertising profiles, and we do not use it to train artificial intelligence systems.

Evaluations, Diagnoses and Other Sensitive Information

Our website and our marketing are directed to parents and adults, not to children. We do not knowingly collect personal information online directly from a child under 13. Any information about a student under 13 comes to us from you, their parent or guardian, and we use it only to provide the instruction you purchased. We agree that a psychoeducational evaluation is sensitive information as is a diagnosis, a disability designation, or a description of how your child is struggling.

We collect this only when you send it, and only use the information to do the work you hired us for. We ask for explicit consent in the new student intake form, separately from your agreement to this policy.

Access is limited to the owner. Contractors do not have access to evaluations, diagnoses or student records. Where a contractor supports work that touches customer information, they are bound by a written confidentiality agreement.

We store these documents in access-controlled cloud storage with multi-factor authentication. They are not emailed around, or kept in a shared folder.

You can withdraw consent and ask us to delete these documents at any time, subject only to records we’re required to retain for a funding program audit. 

No student accounts. We do not create logins, portals or accounts for students under 13, and we do not ask students to fill in online forms.

Recording. We do not record live sessions. If a recording is ever made by agreement, we obtain separate written consent from the parent first, and the recording is used only for the purpose stated in that consent.

Parent rights. As the parent or guardian, you may at any time review the personal information we hold about your child, ask us to correct it, ask us to delete it, and refuse to allow further collection or use. Email info@theliteracykeys.com. We’ll verify your identity as the parent and respond within 30 days.

If you believe a child under 13 has given us information directly, contact us and we’ll delete it.

Who We Share What With

We do not sell your information. We do not rent it, trade it, or share it with data brokers. We do not share student information for anyone’s advertising.

We share only in these situations:

Service providers who help us operate. Categories include payment processing, e-commerce and website hosting, email delivery, video conferencing, scheduling, cloud storage, and course hosting. Each is contractually limited to using the information to provide their service to us. A current list of the providers we use is available on request at info@theliteracykeys.com.

Your funding program, when you use one. If you pay with ESA, scholarship or microgrant funds, we provide the administering organization with what that program requires: invoices, service descriptions, attendance records and receipts. We provide what’s required and nothing more. We do not share evaluations, session notes or progress data with a funding program unless the program specifically requires it and we tell you first.

When you ask us to. For example, sending a prepared documentation packet to your child’s school, or speaking with a psychologist or advocate you’ve engaged. Written request is always required.

When the law requires it. In response to a valid subpoena, court order, or lawful request from a government authority, or where disclosure is necessary to protect someone’s safety.

If the business is sold. If The Literacy Keys is acquired or merged, customer information may transfer as part of that transaction. You will be notified before your information becomes subject to a different privacy policy, and you’ll have the chance to delete your data first.

 

What We Never Do

We will go even further than sharing what we do and include a section on what we do not do:

  • We never sell personal information
  • We never share student information with advertisers or data brokers
  • We never use student information for targeted advertising
  • We never ask for your ESA, scholarship or funding platform login credentials, and we will not accept them if offered
  • We never use student information to train artificial intelligence systems

Email

When you buy something, we send transactional email about your order. You can’t opt out of these and still receive the service.

Marketing email only goes to people who asked for it. Every message has an unsubscribe link that works immediately, and unsubscribing has no effect on the service you purchased.

 

How Long We Keep Things

Our retention is based upon requirements by federal and state agencies.  When a retention period ends, the information will be securely destroyed. We keep:

  • Order and payment records for 7 years per tax and accounting requirements.
  • Program-funded purchase records for at least 5 years, or longer if a program requires it according to the audit obligations.
  • Evaluations and school records for the duration of service plus 1 year.  After that the documents are deleted. This allows us to pick up where a student left off if they return.
  • Session notes and progress date for the duration of service plus 2 years in order to support a later accommodations request.

 

Security

No system is perfectly secure. If a breach affects your information, we’ll notify you and the relevant authorities as the law requires, and we’ll tell you what happened and what to do about it. We are committed to protecting your information with measures appropriate to its sensitivity:

  • Encrypted connections across the site and at checkout
  • Multi-factor authentication on every account that holds customer or student data
  • Access-controlled storage, with evaluations and student records restricted to Tracy Young
  • Payment card data handled entirely by a PCI-compliant processor, never stored by us
  • Require written confidentiality agreements with any contractor who can access customer information
  • Regular software updates and security monitoring on the website

 

Your Rights

Several state laws give residents of those states specific versions of these rights. Rather than making you check whether your state qualifies, we extend all of the following to every customer. It’s simpler and it’s the right answer. Wherever you live, you may:

  • Know what personal information we hold about you and your student
  • Access a copy of it
  • Correct anything inaccurate
  • Delete it, subject to other sections
  • Take it with you in a portable format
  • Opt out of marketing email
  • Opt out of any sale or sharing, though we don’t do either
  • Withdraw consent for sensitive information, including evaluations
  • Not be discriminated against for exercising any of these rights

 

How to exercise these rights: email info@theliteracykeys.com with your request. We’ll verify your identity, which usually means confirming details from your order, and respond within 45 days. If we need longer, we’ll explain why (free of charge). If you’re an authorized agent acting for a customer, send written authorization from them along with your request.

If we say no, we’ll explain why, and you may appeal by replying to that email. We’ll respond to an appeal within 45 days. If we deny your appeal, you may contact your state attorney general.

Podcast, YouTube and Social Media

Our podcast is distributed on Apple Podcasts, Spotify, YouTube and other platforms. Those platforms collect their own listener data under their own privacy policies. We receive only aggregated, anonymous statistics such as download counts and episode completion rates. We do not receive listener identities.

The same applies to our social media pages and any comments you leave there. We ask that you use common sense and not post sensitive details about evaluations or diagnoses in a public comment.

We link to outside resources, including but not limited to schools, advocacy organizations and the College Board. We’re not responsible for their privacy practices. We encourage you to read their policies t see what they do with your information.

Cookie Policy

As we’ve already mentioned, this site uses cookies and we’re not talking about the chocolate chip kind.  It’s about small text files that are secretly placed on your machine.  You may think it’s a conspiracy but it’s really to help the site provide a better user experience (as WE define it!) Basically, cookies retain user preferences (because we all know what it’s like to be forgetful), store information for shopping carts, and provide tracking data to third-party applications like Almighty Google and their Analytics. As a rule, cookies will make your browsing experience better.  At least that’s what everyone is told.

You CAN disable cookies on this site and on others.  The best way to do this is to disable cookies in your browser. If you can figure out how to do this in a relatively short period of time, we might want to hire you.

We honor Global Privacy Control (GPC) and similar browser-based opt-out signals as a valid request to opt out of sale or sharing. Browsers send inconsistent signals, so we respond to GPC rather than to legacy Do Not Track headers.
